Use of Web Site Information

You may download, view, copy and print documents and graphics posted on the Site (the “Documents”) subject to the following: (a) the Documents may be used solely for personal, informational, non-commercial purposes; (b) the Documents and information will be attributed to eMediWorld Lifescience; and (c) the Documents may not be modified or altered in any way. Except where your use constitutes “fair use” under copyright law, you may not otherwise use, download, upload, copy, print, display, perform, reproduce, publish, license, post, transmit or distribute any information from the Site in whole or in part without the express authorization of eMediWorld Lifescience.

Access through Client Login

The portion of the Site accessed through the Client Login page (the “Client Services”) is for use only by current clients of eMediWorld Lifescience. Any attempt by others to access this portion of the Site is prohibited. If you are a current client of eMediWorld Lifescience, the use of services, software and/or accompanying documentation you access through this portion of the Site is subject to the terms of the written master services agreement between you and eMediWorld Lifescience (the “Services Agreement”). All rights, title and interest not expressly granted are reserved. To the extent there is a conflict between these Terms of Use and any provision in your Services Agreement with respect to your use of the Client Services, the terms of the Services Agreement shall prevail.

Passwords and Security

You are responsible for maintaining the confidentiality of any password(s) you are given to access the Site and are fully responsible for all activities that occur under your password(s). You agree to notify eMediWorld Lifescience immediately of any unauthorized use of your password(s).

Refund and Cancellation Policy

You agree that eMediWorld Lifescience may, in its sole discretion, at any time terminate your access to the Site and any account(s) you may have in connection with the Site. Access to the Site may be monitored by eMediWorld Lifescience.

There shall be no refund of fees in the event the services are terminated by you. Please note the following:

• In case you avail of the services listed on www.abcHealth.in and are, thereafter, not available on the contact details provided in the registration form, then the service selected by you will stand automatically cancelled and eMediWorld would not be liable for any charges/expenses incurred by you, either directly or indirectly in this regard.
• We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

You acknowledge that eMediWorld Lifescience does not control information, products or services offered by third parties through the site. except as otherwise agreed in writing, eMediWorld Lifescience and its affiliates assume no responsibility for and make no warranty or representation as to the accuracy, currency, completeness, reliability or usefulness of any advice, opinion, statement or other content or of any products or services distributed or made available by third parties through the site. eMediWorld Lifescience does not make any warranty that this site or its content will meet your requirements, or that this site or its content will be uninterrupted, timely, secure, or error free, or that defects, if any, will be corrected. nor does eMediWorld Lifescience make any warranty as to the results that may be obtained from use of this site or its content or as to the accuracy, completeness or reliability of any information obtained through use of this site.

eMediWorld Lifescience assumes no responsibility for any damages suffered by a user, including, but not limited to, loss of data from delays, non-deliveries of content or email, errors, system down time, misdeliveries of content or email, network or system outages, file corruption, or service interruptions caused by the negligence of eMediWorld Lifescience, its affiliates, its licensors, or a user’s own errors and/or omissions except as specifically provided herein, eMediWorld Lifescience disclaims any warranty or representation that confidentiality of information transmitted through the site will be maintained. No advice or information, whether oral or written, obtained by you from eMediWorld Lifescience or through the site shall create any warranty not expressly stated in writing. Some states do not allow the limitation or exclusion of certain warranties or conditions, so some of the above exclusions may not apply to you.

Limitation of Liability

in no event shall eMediWorld lifescience be liable for any direct, indirect, incidental, special or consequential damages, or damages for loss of profits, revenue, data or use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to, or use of, the site. some jurisdictions do not allow the limitation or exclusion of liability. accordingly, some of the above limitations may not apply to you.

Indemnity

You agree to defend, indemnify and hold harmless eMediWorld Lifescience, its officers, directors, doctors, employees and network partners from and against any and all claims, liabilities, damages, losses or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the Site.

Note about Children

Minors are not eligible to use the Site. eMediWorld Lifescience asks that they do not submit any personal information..

Applicable Laws

All matters relating to your access to and use of, the Site shall be governed by the laws of State of Maharashtra. Any legal action or proceeding relating to your access to, or use of, the Site shall be instituted in Mumbai, Maharashtra. You and eMediWorld Lifescience agree to submit to the jurisdiction of and agree that venue is proper in, Mumbai court in any such legal action or proceeding.
